According to the present rental agreement, the Lessor will be obligated to give to the Lessee’s usage the vehicle specified in the agreement which is called the object of the agreement. The Lessee is obligated to  pay rental to the Lessor for the entire rental period. In the case that the vehicle or another rented object marked in this agreement as the object of the agreement is returned before the agreed time, no rental payments will be returned to the Lessee.

General requirements

1. Minimal rental period is one day

2. Payment is made before the rental period, either in cash, with a banking card or with a transfer on the basis of an invoice. The rental payment includes the motor third party liability insurance, the casco insurance and the VAT tax. From a private person we require the payment of a deposit that is returned to the Lessee after the rental period unless there occur unforeseen events (an insurance case, a dirty vehicle, vehicle out of fuel, a parking ticket). From legal persons we require a guarantee letter and a valid (not older than 15 days) copy of the business registration card, Part B.

3. The necessary documents: a passport or the ID card and the driving licence, the copies of which will remain at AT RENT OÜ. The driver’s licence must be in Latin alphabet , otherwise the international driver’s licence is required plus at least two years of driving experience (temporary licence is not accepted).

4. The Lessee must take good care of the vehicle. It is prohibited to use the vehicle for illegal causes, for towing, car racing, training, etc. It is prohibited to drive the vehicle outside the roads suited for the vehicle.

5. The Lessee must drive the rented vehicle personally and not to give it for use of third persons without the Lessor’s respective written agreement on the rental agreement.

6. The Lessee is fully responsible for any details or equipment missing from the rental vehcile. In the event of an accident, the Lessee will be obligated to indemnify the loss in the amount of the deductible stated in the Agreement. If the rental vehicle is damaged due to the Lessee’s negligence or his intentional actions, the Lessee will be liable in full amount for the loss caused to the vehicle, regardless of the amount of deductible of the Agreement. The deductible for the Lessee is 3,000 – 5,000 kroons. The Lessee is fully liable for the loss caused to the vehicle even if the loss was caused from disregard of the contractual obligations or if the Lessee used the vehicle while being intoxiated by alcohol or drugs, used it for criminal purposes, etc.

7. In the event that the vehicle is stolen, the Lessee must return to the Lessor all documents and keys of the vehicle, otherwise he will be considered fully responsible for the stolen vehicle. For the time spent for repairing the damages caused by incorrect usage of the vehicle, the Lessee pays rental in the amount of one day’s rental for one day of repairs, but for not more than 30 days. Fine for the lost keys, documents or broken tyres is 1,200 – 3,000 EEK. The site and scales of the repairs of the vheicle is to be determined by the Lessor.

8. The Lessee is liable for the loss caused to the vehicle by third parties.

9. The rental payment does not include the fuel. The rental vehicle is transferred to the Lessee with a full tank and must have a full tank when returned. If the returned vehicle does not have a tank full of fuel, the Lessee must pay for the missing fuel and the extra 170 EEK for filling up the tank.

10. The Lessee is obligated to follow the state of the vehicle (oil, coolant, interior and exteriod lamps, air pressure in tyres, etc.) during the entire rental period. Any costs related to these items resukting from normal exploitation of the vehicle are to be covered by the Lessor.

11. The Lessor is not liable for the costs that the Lessee may experience in connection with a halted trip due to the vehicle’s breakdown and/or technical malfunctions.

12. In the event of an accident, injured persons, damage to the rental vehicle or theft of the parts of the vehicle, the Lessee will inform about the event immediately the police and the Lessor, and will submit a written explanatory letter to the Lessor within 24 hours from the day of the event.

13. A rental day lasts for 24 hours. A Lessee must guarantee that the vehicle is returned to the Lessor at the agreed time and to the agreed site. If the rental vehicle is not returned by the due time, the Lessee will pay rental for the exceeded time in the amount that is three times higher than the original agreed amount and the Lessee is considered liable for the economic loss to the Lessor due to the late return. If the Lessee does not pay rental payment by the due date, he will pay a fine for delay in the amount of 2% in a day for the unpaid amount.

14. The Lessee is obligated to pay the fines or claims caused during the exploitation of the property for breaking the law, according to the ways foreseen by the law and on the basis of the Lessor’s price lists, but not less than 500 kroons.

15. Taking the rental vehicle across the Estonian border is prohibited, unless this is agreed beforehand.  

I. General stipulations

1. The rental agreement is valid from the moment it is concluded until the moment the vehicle is returned to the site stated in the agreement, at the time stated in the agreement, provided there are no claims by the parties; in the event there are claims the agreement will be held valid until the claims are settled.

2. A rental day lasts for 24 hours.

3. The fuel is not included in the rental amount. The vehicle is given to the Lessee with the tank full of fuel and the Lessee will return the vehicle with the tank full of fuel.

4. The present agreement will become in force the moment it is signed and will end by the return of the vehicle provided there are no claims.

II. Rights of the Lessee

1. The Lessee is entitled to use the vehicle.

2. The Lessee is entitled to the income gained from the usage of the vehicle.

3. The Lessee is entitled to the indemnity for the loss caused to him/her by third parties.

4. The Lessee is entitled to use the vehicle only if he/she is at least 21 years old and has at least 2 years of driving experience; the same requirements apply to the second driver.

III. Obligations of the Lessee

1. The Lessee must make an advance payment for the rental period.

2. The Lessee is obligated to check the vehicle before accepting it for his/her usage and to be convinced that it suits him/her and is in good order. The signature on the agreement confirms that there are no pretentions.

3. The Lessee is obligated to use the vehcile according to the manufacturer’s instructions.

4. The Lessee takes good care of the vehicle and eliminates any shortcomings according to thre Estonian Law of Obligations Act, § 345, section 1 (covers the costs).

5. The Lessee must not use the vehicle for: illegal activities or purposes, for towing, car racing, trainings, etc.

6. The Lessee is obligate to use the vehicle only on the roads that are considered as roads in the meaning stipulated in the Estonian Roads Act.

7. The Lessee must not give the vehicle to the usage of third parties, except for the second driver that is stated in this agreement, in which case the Lessee must remain in the vehicle.

8. The Lessee or the second driver is obligated to check the vehicle’s technical state before each ride and to check the technical conditions of the vehicle during driving; in case there is a techical problem the Lessee/second driver must stop driving until the problem is eliminated.

9. When filling the vehicle’s tank with fuel, the Lessee must use only quality fuel and the fuel designated for this vehicle.

10. The Lessee is obligated to do everything he/she can to avoid causing loss to the Lessor as well as to third parties.

11. In the event of an accident, theft, vandalism, etc., the Lessee will inform the Lessor immediately about the event. The Lessee will inform the rescue service or the police in the case that this obligation is stipulated by the law.

12. The Lessee will return the vehicle at the agreed time to the agreed site. The Lessee must not abandon the vehicle.

13. In the case there has been caused any loss to the Lessor or third parties or if there are documents or object missing, the Lessee and the second driver are obliged to submit a written explanatory letter to the Lessor within 24 hours. Should there be no other means of correspondence, the explanatory letter – digitally signed - may be sent to the Lessor’s e-mail address.

14. In the event that the Estonian kroon is devaluated or there are no fixed exchange rates, the rental payment will be made in euros according to the exchange rate of the time of concluding the agreement.

IV. Liabilities of the Lessee

1. The costs caused by the traffic accident or illegal actions of third parties will be covered by the Lessee to the extent that is not covered by the insurance (incl. the deductible amount).

2. The Lessee is fully liable for any details or additional equipment that are missing from the vehicle or that have been replaced.

3. The Lessee will cover the loss if the vehicle is damaged by him/her or third parties.

4. If the Lessee or the second driver have vcaused with their actions (activity or inactivity) intentional loss the Lessor or third parties, the Lessee will cover the entire loss amount.

5. The Lessee will cover the entire loss amount if the loss has been caused by the Lessee or the second driver while being intoxicated.

6. If the Lessee transfers the vehicle to a third party, the Lessee covers the full amount of the loss caused to the Lessor or third parties.

7. In the event of theft, the Lessee will cover the entire loss amount unless he/she returns to the Lessor the keys to the vehicle, the alarm controls, the immobilizer activator/deactivator and the vehicle’s registry certificate and the insurance policies.

8. If the vehicle returned by the Lessee needs repairs, the Lessee will pay rental amount for each repair day in the amount of a rental day, in addition to the repair costs.

9. The Lessee will cover the damage caused by poor quality fuel.

10. If the Lessee does not return to the Lessor the vehicle’s documents or keys or if there is equipment missing from the returned vehicle, the Lessee will pay to the Lessor the fine of 3,000 kroons per each lost or missing document or article.

11. If the Lessee returns the vehicle which tank is not full of the fuel foreseen for this type of vehicle, the Lessee will pay the 200 kroons foreseen for the filling of the tank, plus the cost of the missing fuel.

12. Should the Lessee abandon the vehicle, he/she will pay the Lessor a fine in the amount of the vehicle’s original acquiring cost.

13. The Lessee is liable for the Lessor according to the principles of ownership and will pay the fines issued for the Lessor.

V. Obligations of the Lessor

The Lessor is obliged to give the vehicle to the Lessee at the time and on the site stated in the Agreement .

The Lessor is obligated to fulfill the agreement in bona fide.  

VI. Rights of the Lessor

1. The Lessor is entitled to demand the deposit in the amount of deductible.

2. The Lessor is entitled to check the vehicle’s status and the ways of maintaining its condition.

3. The Lessor determines the repair site of the vehicle and the conditions and the scale of the repairs, irrespective of the vehicle’s actual location.

4. The Lessor will be entitled to refuse from renting the vehicle or to terminate the rental agreement if the Lessee or the second driver do not look trustworthy or if it may be expected that the vehicle is used for malicious/illegal  purposes or the rules of exploitation are neglected.

5. Any loss from the malfunction of the vehicle and other loss (traffic accident, cancelled or halted trip, loss from nonfulfilment or professional or other duties of the Lessee or the second driver to a third party) will not be covered by the Lessor. These costs must be covered by the Lessee and these are considered as the rental risk.

6. In the case that the Lessee does not inform the Lessor about the event of loss, he/she will pay three times more for the rental amount and will cover the consequence loss caused to the Lessor.
